The Obama-appointed judge issued a restraining order to block President Donald Trump’s use of the 1798 Alien Enemies Act, which was invoked to deport members of the Venezuelan gang Tren de Aragua, recently classified as a Foreign Terrorist Organization. The clash between the judiciary and the executive branch has ignited a firestorm of controversy, with critics accusing Boasberg of judicial activism and overreach. The judge’s order, issued in the early hours of Saturday, demanded that planes carrying Tren de Aragua members be returned to the U.S., even as deportations were already underway. Judge Boasberg’s decision to intercede in matters of foreign policy and immigration, areas constitutionally reserved for the executive branch, has drawn sharp criticism from lawmakers and legal experts alike. Rep. Gill, in a post on X, declared, “I’ll be filing Articles of Impeachment against activist judge James Boasberg this week.” He emphasized that the individuals in question are “foreign gangbangers” guilty of crimes including kidnapping, sexual abuse of children, aggravated assault, and robbery. The Trump Administration, however, refused to comply with Boasberg’s order, citing the flights’ location over international waters at the time of the ruling. White House Press Secretary Karoline Leavitt stated, “If the Democrats want to argue in favor of turning a plane full of rapists, murderers, and gangsters back to the United States, that's a fight we are more than happy to take.” Leavitt further clarified that the administration’s actions were consistent with the Supreme Court’s precedent, which upholds the President’s authority over foreign affairs and the removal of foreign alien terrorists. “A single judge in a single city cannot direct the movements of an aircraft carrier full of foreign alien terrorists who were physically expelled from U.S. soil,” she added.

Tren de Aragua: a threat to national security

Tren de Aragua, a Venezuelan criminal organization, has been linked to a wave of violent crimes across the U.S., prompting its classification as a Foreign Terrorist Organization. The Trump Administration’s decision to deport 238 gang members to El Salvador’s Terrorism Confinement Center (CECOT) marks a significant step in addressing the threat posed by this transnational criminal network. El Salvadoran President Nayib Bukele shared footage of the prisoner transfer on X, writing, “Today, the first 238 members of the Venezuelan criminal organization, Tren de Aragua, arrived in our country. They were immediately transferred to CECOT, the Terrorism Confinement Center, for a period of one year (renewable).” Bukele noted that the U.S. would pay a nominal fee for the arrangement, which aligns with his administration’s efforts to make the prison system self-sustainable through inmate labor programs. In addition to the Tren de Aragua members, 21 MS-13 gang members were also deported to the Salvadoran facility.
